How to Change Your Name in Florida

How to change your name in Florida after marriage with the NameChange kit How to change your name in Florida after marriage with the NameChange kit

Florida puts a real clock on this. Most states publish no deadline at all for a name change on your licence, and Florida gives you 30 days, counted from the day your name changed. It is also one of the few states where that same 30 days covers your car as well as your licence. So a Florida name change is not a job you can leave until the honeymoon photos are printed.

There is a second Florida quirk that catches newlyweds specifically, and it is about the certificate itself rather than any agency. We will get to it in step one, because it decides whether this takes two weeks or two months.

This page covers all four routes to a name change in Florida: marriage, divorce, a court petition when you are choosing a new name outright, and a child's name change. Start with the one that applies to you, then follow the same update order.

Do this first: the Florida name change order

Work top to bottom. Each step is what makes the next one possible:

  1. Get certified copies of your Florida marriage certificate, your divorce judgment, or your court order.
  2. Update your Social Security record and wait for it to settle.
  3. Update your driver's licence in person at a Florida driver licence service centre.
  4. Apply for a new printed vehicle title, and update your registration.
  5. Update your voter registration, which Florida lets you do online.
  6. Update your U.S. passport.
  7. Clean up the rest: bank, employer, insurance, doctor, subscriptions.

The Florida 30 day rule, and what it actually covers

This is the part most guides get half right, so it is worth being precise.

Florida's requirement is that a name change is reflected on both your driver licence or ID card and your vehicle title and registration within 30 days. Not the licence alone. In most states the car is a separate errand with no clock on it. In Florida it sits inside the same window, which is why people who deal with the licence promptly and leave the car for a rainy afternoon are the ones who end up out of time without realising.

Two practical consequences. First, plan the licence and the vehicle paperwork as one job rather than two. Second, start the sequence early, because Social Security has to come first and that is a few days of the 30 gone before you have done anything visible.

Step 1. Get certified copies of your Florida marriage certificate

Here is the Florida detail that decides your timeline, and it is genuinely unusual.

Florida marriage records from 6 June 1927 onward are held centrally by the Florida Bureau of Vital Statistics, not by the county. That is the opposite of how most states work. So the certified copy you need comes from the state.

But it does not get there quickly. After your ceremony the licence goes back to the Clerk of the Circuit Court, is filed and recorded, and is then forwarded to the Bureau of Vital Statistics for permanent filing. That process takes around 60 days.

Read that against a 30 day deadline and the problem is obvious. If you were married recently, the state may not have your record yet, while your clock is already running.

The answer is the county. If your ceremony was less than 60 days ago and you need proof now, go to the Clerk of the Circuit Court in the county that issued your marriage licence. That office has the record from the moment it is recorded, long before the state does. Marriages before 6 June 1927 come from the county clerk too.

Order two or three certified copies. Social Security wants one, the licence counter wants one, and a passport application is a third. Ordering again halfway through is what turns this into a two month job.

The keepsake certificate from your ceremony is not a certified copy. You need the certified version.

Step 2. Update your Social Security card

Federal, so Florida does not change it, but the sequence does depend on it.

You submit an application for a corrected card with your certified proof and your identification. There is no fee, your number does not change, and the new card arrives by mail.

Then wait a day or two before going to the licence office. Florida checks your new name against the Social Security record, and the state's own guidance is that the change has to be made with Social Security first. Turning up the same afternoon is the most common wasted trip in this entire process, and in Florida it costs you days you have actually been given a deadline for.

The full walkthrough is here: the Social Security name change, start to finish.

Step 3. Update your Florida driver's licence

In person. There is no online route for this one.

Florida is explicit about the split: address changes can be done online, name changes cannot. A name change means a new card, a new photo and a new signature, so it has to happen at a counter. You go to a driver licence service centre or a county tax collector office that handles driver licences, with your certified proof, your current licence, proof of your Social Security number and proof of Florida residency.

This is also the natural moment to deal with REAL ID if you have not already. You are standing at the counter with certified documents in your hand, which is exactly what a REAL ID application wants to see. Doing it now saves a second trip with the same paperwork.

Confirm the current fee with the office before you go rather than trusting a figure from a blog, including ours. Fees change.

Step 4. Your car: the printed title trap

This is the Florida step people think they have finished when they have not, and it is worth reading twice.

When your new name goes on your driver licence, your electronic title updates automatically. That sounds like the job is done, and for the electronic record it is.

Your printed title still shows your old name. It keeps showing your old name until you actually apply for a new one, using the Application for Certificate of Title With or Without Registration, form 82040. If you hold a paper title, or you are about to sell or refinance the vehicle, that mismatch is a real problem at exactly the wrong moment.

You handle this at a county tax collector office or a licence plate agent office, which act for the state on vehicle work. Bring your certified proof and your new licence.

If your vehicle is financed or leased, your lienholder holds the title and has to be part of a title change. Call them before you make the trip, not after.

Step 5. Update your voter registration, and yes, online

A rare easy one, and Florida is on the good side of this.

You can update your existing voter record online at RegisterToVoteFlorida.gov, at any time. The system asks for details only you should have: your Florida driver licence or state ID number, the date that card was issued, and the last four digits of your Social Security number. Those are checked in real time, which is why the whole thing finishes in one sitting.

Do this after your licence, not before. The system verifies against your licence record, so updating the licence first is what makes the online route work smoothly.

Your county supervisor of elections has up to 13 days to process it, and it can take another day or two to show online. So it is quick to submit and slow to appear. Submit it and move on rather than refreshing.

Step 6. Update your U.S. passport

Federal again, and it belongs here because you will not want a separate trip for it.

You send your current passport, your certified proof, a new photo and the correct form. Which form applies depends on how recently your passport was issued, and picking the wrong one is what makes people pay a full renewal fee instead of a cheaper correction. If you have travel booked, start this early. Passport processing runs on its own clock and ignores your 30 days entirely.

Changing your name in Florida after divorce

Read the judgment first.

A Florida court can restore a former name as part of a dissolution of marriage where it was asked for. Where the judge granted it, the judgment is your legal proof, used exactly the way a marriage certificate is used above. Order certified copies from the clerk of the court that granted it, and order more than one, because the licence counter, the tax collector and the passport agency will each want to see it.

If your name is not addressed in the judgment, the divorce did not change it, and you are on the petition route below. That one line decides your path and it is easy to skim past.

There is a Florida bonus worth knowing: restoring a former name is the one route that skips the fingerprint step described next. It matters more than it sounds.

The full sequence, including what each agency rejects and why, is in our divorce name change checklist.

Changing your name in Florida by court petition

This is the route for choosing a new name outright rather than taking or restoring one through a marriage or a divorce. Florida asks more of you here than most states do, and the extra step is not a formality.

You file a petition for change of name in the circuit court, and the court has to find that you are a genuine resident of that county, that you are not doing this for any ulterior or illegal purpose, and that granting it will not invade anyone else's property rights.

The fingerprint step is the Florida one. Unless you are restoring a former name, you must have fingerprints submitted for a state and national criminal records check, taken in a manner approved by the Florida Department of Law Enforcement.

Then the timing detail that decides how long this takes: you cannot request a hearing until the clerk has received the results of that check. Your petition does not sit in a queue behind other people, it sits behind your own fingerprints. The state's own guidance says the process may take several weeks, and you pay for the processing and the records check.

So budget for it at the start. The clerk of your county court can tell you how to get fingerprints taken and which providers can submit them electronically, which is the faster route. Filing fees and local rules vary by county, so confirm both with the clerk before you file. This is also the one route where a lawyer is genuinely worth considering.

Changing a child's name in Florida

A parent or legal guardian files a petition for change of name of a minor child in the circuit court.

Consent decides how this goes. Ordinarily both parents join the petition or agree to it. Where one objects, the court can still grant it, but the question becomes whether the change is in the child's best interest, and that is a contested hearing rather than a formality. If the judge approves, the signed order is what updates the child's identification, school records and accounts.

Three things that trip people up in Florida

Ordering the marriage certificate from the state too soon. The record takes around 60 days to reach the Bureau of Vital Statistics. If you married recently, the county Clerk of the Circuit Court has it and the state does not.

Thinking the licence finished the car. It updated the electronic title only. The printed title keeps your old name until you apply for a new one with form 82040.

Reading the 30 days as licence only. It covers the vehicle title and registration in the same window.

How the kit handles the tedious part

All of the above is doable alone. What it costs you in Florida specifically is the sequencing under a deadline: certified copies from the right office, Social Security settled before you queue, and the car dealt with inside the same 30 days rather than after them.

Our name change kit gives you the Florida paperwork already filled in, in the order the offices want it, with stamped envelopes. It covers marriage, divorce and a court order alike. It does not replace the offices, and NameChange does not issue any legal document for you, so the marriage certificate, the judgment and the court order still come from Florida. What the kit removes is the assembly work, so nobody sends you home.

Florida name change FAQ

How long do I have to change my name in Florida?

From the Florida Bureau of Vital Statistics for marriages from 6 June 1927 onward. But the record takes around 60 days to reach the state, so if you married recently, order from the Clerk of the Circuit Court in the county that issued your licence.

Can I change my name on my Florida licence online?

No. Florida allows address changes online but requires all name changes to be done in person, because a name change means a new photo and signature.

Yes, at RegisterToVoteFlorida.gov, using your Florida licence or ID number, its issue date and the last four digits of your Social Security number. Do it after your licence so the records agree.

What does the name change kit actually do?

You get a personalized checklist, your Florida and federal forms pre-filled, and instructions in the right order. You still sign and submit yourself. See what is in the kit.

The bottom line

A name change in Florida gives you 30 days and counts your car inside them, so the sequence matters more here than in most states. Certified copies from the county clerk if you married recently, Social Security, then the licence counter in person, then a new printed title, then voter registration online. If you would rather not work out which office wants what and in what order, the name change kit does that part.

Changing your name in another state?

The order holds everywhere, the offices do not. See Georgia, Alabama, and South Carolina, or browse all fifty on our name change by state directory.
