How to Change Your Name in California
The single most useful thing to know about changing your name in California is that the decision starts earlier than most people think. California puts a field for your married name on the marriage license application itself, before the wedding, and the choice you write there is the one your certificate carries afterwards. Get that right and the rest is errands. Get it wrong and you are amending a record instead of using one.
This page covers all four California routes: marriage, divorce, a court petition when you are choosing a new name outright, and a child's name change. Find the one that applies to you, then follow the same update order from there.
Do this first: the California name change order
Work top to bottom. Each step is what makes the next one possible:
- Get your proof: certified copies of your California marriage certificate, your divorce decree, or your court order.
- Update your Social Security record.
- Apply for your new California driver's license or ID, then finish it in person at a DMV field office.
- Update your vehicle title and registration.
- Re-register to vote.
- Update your U.S. passport.
- Clean up the rest: bank, employer, insurance, doctor, subscriptions.
Step 1. Get certified copies of your California marriage certificate
Every office below wants to see this document, so it is the one that sets your timeline.
Your certificate is held by the county clerk or county recorder in the California county that issued your marriage license. It is not held in Sacramento by default, and it is not the decorative certificate your officiant signed at the ceremony. You need the certified version with the county's seal on it.
California has two kinds of marriage license, and it matters here. A public marriage license produces a public record, and a certified copy can be requested by anyone entitled to it under state rules. A confidential marriage license produces a record that is not public: only the spouses can obtain a copy of it, and requests generally go back to the county clerk who issued it rather than to a records office. If you married on a confidential licence, expect a narrower set of ways to order copies and plan a little more time for it.
Order two or three either way. Social Security wants one, the DMV wants one, and a passport application is a third. Reordering mid-process is the thing that turns a two week job into a six week one.
Fees and turnaround are set county by county, so check your county clerk or recorder's page for the current cost before you order.
Step 2. Update your Social Security card
This step is federal and identical in every state, but in California it is load bearing, because the DMV verifies the name on your application directly against Social Security's records. If the two do not agree, your DMV application is rejected and you are sent a Request for Verification of Information letter explaining what to do next. That is a wasted trip and a fresh wait.
You submit an application for a corrected card with your certified proof and your identification. There is no fee, your Social Security number does not change, and the new card arrives by mail. Then give it time to land in the system before you go anywhere near the DMV.
The full walkthrough is here: the Social Security name change, start to finish.
Step 3. Update your California driver's license at the DMV
California splits this into an online half and an in person half, and people routinely do the first and assume they are finished.
You start by filing a new driver's license or ID application through the DMV's online portal under your new name, and you can ask for it to be a REAL ID in the same application. The name change is not complete until you visit a DMV field office in person. There is no fully remote path.
What to bring depends on which card you are getting:
- For a REAL ID: proof of identity, your Social Security number, and two proofs of California residency.
- For a standard licence or ID: proof of your legal full name.
There is a California specific trap here worth knowing in advance. If you have changed your name before, the DMV can ask you to document the whole chain, not just the most recent change. That means every link: earlier name change orders showing the name before and after, marriage certificates, divorce or domestic partnership dissolution papers, domestic partnership formation documents, adoption papers. Someone on a second marriage who only brings the current certificate is the classic rejection at the counter.
Make an appointment if you can. California field offices take walk ins, but the appointment is the difference between twenty minutes and most of a morning.
Step 4. Update your vehicle title and registration
California runs vehicles through the DMV as well, but it is a separate transaction from your licence with its own paperwork, and the form you need is the same one in all three situations: a Statement of Facts, form REG 256, Section F.
- If you hold the title: write your corrected name on the title above the name being replaced, complete and sign Section F of the REG 256, and take both to a field office or mail them to Vehicle Registration Operations in Sacramento.
- If the title is lost, stolen or damaged: add an Application for Replacement or Transfer of Title, form REG 227, plus at least one proof of ownership such as the registration card or a letter of release from your lienholder, and expect a duplicate title fee. Changing the name on the registration itself has to be done in person.
- If a lienholder holds the title: sign the REG 256 and send it to them. They submit it to the DMV with the title on your behalf, so start that conversation early rather than after your own paperwork is done.
One quirk that surprises people and is not a mistake: a hyphenated or multi word surname prints as a single word on the California Certificate of Title and registration card. That is how the system stores it. It does not need correcting and the DMV will not treat it as an error.
Step 5. Re-register to vote
California does not amend your voter record, it replaces it. After a legal name change you re-register to vote rather than editing the registration you already have, and the Secretary of State's guidance is to update your licence or ID with the DMV first so the two records agree when yours is created. Doing it in that order is the whole trick, and it takes a few minutes online.
Step 6. Update your U.S. passport
Federal again, identical everywhere, and it belongs on this page because you are not going to make a separate trip for it.
You send your current passport, your certified proof, a new photo and the correct form. Which form applies depends on how recently your passport was issued, and choosing the wrong one is what makes people pay a full renewal fee instead of a cheaper correction. If you have travel booked, start this before the DMV. Passport processing runs on its own clock.
Changing your name in California after marriage, before the wedding
This is the California step that has no equivalent in most states, and it is the reason the top of this page says the decision starts early.
When you apply for your marriage license at the county clerk, the application asks what name each spouse intends to use after the marriage. Whatever is entered there is what appears on the certificate, and the certificate is what every agency above reads. Procedures vary between the fifty eight counties, so confirm with the clerk you are applying to, but the principle holds statewide: your married name is declared at the licence stage, not afterwards.
If you have already married and the name on your certificate is not what you want, you are not stuck. You are simply on the petition route below instead of the certificate route.
Changing your name in California after divorce
Read the decree before you do anything else.
In California a request to restore a former name can be included in the divorce itself. Where the judge approved it, the name change takes effect when the decree is signed and the decree is your legal proof. Order certified copies from the court that granted it and use them exactly the way a marriage certificate is used in the steps above.
If the decree does not address your name, the divorce did not change it, and you are on the petition route. That single line decides which path you are on and it is easy to skim past.
The full sequence, including what each agency rejects and why, is in our divorce name change checklist.
Changing your name in California by court petition
This is the route for choosing a new name outright rather than taking or restoring one through a marriage or a divorce. It is a real court process, and California adds a step most states do not.
You file a Petition for Change of Name in the Superior Court for the county where you actually live. Filing in the wrong county is the most common reason a California petition stalls. The petition states your current name, the name you want and your reasons, a background check may apply, and the court schedules a hearing. If the judge grants it you receive an Order Granting Name Change, and that order becomes the document every agency above will want to see.
The publication step. Adult name changes by petition in California generally require public notice: a notice published in a court approved newspaper in your county, once a week for four consecutive weeks. The newspaper issues a Proof of Publication to you and to the court, and you need it to finish at your hearing. Skipping it or publishing in the wrong paper can get the case dismissed. Two things narrow it: publication is not required for a name change through marriage or divorce, and in sensitive circumstances, including domestic violence and gender identity, you can ask the court to waive it.
Approved newspapers, filing fees and local rules are set by each Superior Court, so confirm both the fee and the paper list with your county's court before you file. If cost is the obstacle, California has a Request to Waive Court Fees you can submit with the petition. This is also the one route where a lawyer is genuinely worth considering.
Changing a child's name in California
A parent or guardian files a Petition for Change of Name in the Superior Court for the county where the child lives, giving the child's current name, the proposed name and the reasons.
Consent decides how smooth this is. Ordinarily both parents agree. Where one does not, the court can still grant it, but the question becomes whether the change is in the child's best interest, and that is a contested hearing rather than a formality. If the judge approves, the signed order is what updates the child's records.
Three things that trip people up in California
Doing the DMV application online and stopping there. The online form starts it. A field office visit finishes it. Plenty of people believe they are done and find out at a traffic stop or an airport.
Bringing only the latest certificate. If there was an earlier name change, California can ask for the entire documented chain. Dig out the older paperwork before the appointment, not at the counter.
Updating voter registration before the DMV. California wants you to re-register, and it wants your licence to already show the new name. Reversing the order means doing it twice.
How the kit handles the tedious part
Every step above is doable on your own. What it costs is the assembly: knowing that a REG 256 exists, knowing the DMV visit is mandatory, knowing which of your old documents California will ask for, and entering the same details eight times without a typo.
Our name change kit gives you the California paperwork already filled in, in the order the offices want it, with stamped envelopes. It covers marriage, divorce and a court order alike. It does not replace the offices, and NameChange does not issue any legal document for you, so the marriage certificate, the decree and the court order still come from California. What the kit removes is the assembly work, so nobody sends you home.
California name change FAQ
Where do I get a certified copy of my California marriage certificate?
From the county clerk or county recorder in the California county that issued your marriage licence. If yours was a confidential marriage licence, the record is not public and generally only the spouses can obtain a copy, so requests go back to the issuing county clerk.
Do I need a court order to change my name after marriage in California?
No. Your marriage certificate is the legal instrument. A court order is for a name that is not connected to a marriage or a divorce, such as choosing an entirely new one.
Do you have to publish a name change in California?
For an adult name change by court petition, generally yes: a notice in a court approved newspaper in your county, once a week for four consecutive weeks, with the Proof of Publication filed before your hearing. It is not required for a name change through marriage or divorce, and the court can waive it in sensitive circumstances such as domestic violence or gender identity.
Can I change my name at the California DMV online?
You can start it online, and you cannot finish it there. The application is filed through the DMV portal, then completed in person at a field office. Bring your proof, and if you have changed your name before, bring the documents for those changes too.
Do I update or re-register my California voter registration?
You re-register. California creates a fresh record rather than editing the old one, and the Secretary of State advises updating your DMV licence or ID first so the two agree.
Why is my hyphenated surname printed as one word on my title?
Because that is how the California Certificate of Title and registration card store multi word surnames. It is not an error and it does not need correcting.
What does the name change kit actually do?
You get a personalized checklist, your California and federal forms pre-filled, and instructions in the right order. You still sign and submit yourself. See what is in the kit.
The bottom line
Changing your name in California is a document problem, not a legal one, as long as you took your married name at the licence stage. Get certified copies from the issuing county, let Social Security catch up, file the DMV application and then actually go in, do the vehicle paperwork with a REG 256, and re-register to vote afterwards. If you would rather not assemble all of that yourself, the name change kit does that part.
Changing your name in another state?
The order holds everywhere, the offices do not. See Arizona, Nevada, and Oregon, or browse all fifty on our name change by state directory.
